1. Partner visa subclasses 820 / 801 (Onshore)

This visa is available to applicants who are in Australia at the time of application and allows them to remain in the country while their application is being processed.

Eligibility criteria:

  • Applicants must be sponsored by their eligible Australian or New Zealand partner.
  • The applicant and their sponsor must:
    • Be married,
    • Be in a de facto relationship of at least 12 months, or
    • Be in a registered relationship in an Australian state or territory (even if the relationship is less than 12 months old).

Visa stages:

  • Subclass 820: Provisional visa granted initially.
  • Subclass 801: Permanent visa granted once the requirements for the permanent stage are met.

Required documentation:

Applicants must provide evidence to demonstrate the genuineness of their relationship in the following areas:

  1. Financial aspect (e.g. shared accounts, joint expenses).
  2. Social aspect (e.g. joint social activities, recognition by family and friends).
  3. Nature of household (e.g. shared living arrangements).
  4. Mutual commitment (e.g., future plans, shared responsibilities).

2. Partner visa subclasses 309/100 (Offshore)

This visa is designed for applicants who are outside Australia at the time of application and allows them to enter the country under the sponsorship of their partner.

Eligibility criteria:

  • Applicants must meet the same relationship requirements as subclasses 820/801:
    • Marriage,
    • De facto relationship (minimum 12 months), or
    • Australian registered relationship.

Visa stages:

  • Subclass 309: Provisional visa granted initially.
  • Subclass 100: Permanent visa granted once eligibility is confirmed.

Required documentation:

  • Applicants must submit evidence covering the same four areas of the relationship: financial, social, household and commitment.

3. Provisional Marriage Visa Subclass 300 (Fiance Visa)

This visa is designed for applicants located outside Australia who plan to marry their eligible Australian or New Zealand partner after arriving in the country.

Key Features:

  • The visa is valid for 9 months, during which the applicant must:
    • Travel to Australia,
    • Marry their sponsor, and
    • Apply for an Onshore Partner Visa Subclass 820/801.

Eligibility Requirements:

  • Applicants must submit a Notice of Intention to Marry (NOIM) as evidence of their genuine intention to marry.
  • The marriage must take place within the 9-month validity period of the visa.Top of Form
