They have the right to appeal to an administrative tribunal (ART).

This tribunal will decide the issue in dispute, either by reaffirming the Department’s decision, varying it, replacing it or sending it back for reconsideration. In many cases, the appeal to the Tribunal means a last chance to remain in Australia. Therefore, a well-founded application, with solid evidence and proper preparation to face this tribunal, requires expertise and knowledge that is not, in most cases, within the reach of the applicants themselves. Appeals (Administrative Appeals Tribunal – ART)

If a visa application is refused

The applicant may lodge an appeal with the relevant tribunal, provided the application was initially submitted onshore and
the appeal is filed within 28 days of the refusal. Reasons for refusal can vary, and the evidence required to challenge the decision will depend on the specific grounds for refusal.

During the appeal process, applicants may remain in Australia on a Bridging Visa A until the tribunal issues its decision, providing an opportunity to address the issues raised in the initial refusal.
